Approve Budget Amendment Resolution for Waterway Development Projects
Approves the creation of sixteen new navigation related major maintenance projects that are funded by a grant from the West Coast Inland Navigation District (WCIND) in the amount of $1,776,594. For the majority of these projects, Lee County will serve as the administrator for other County sub-grant agreements. The projects to be funded are in the categories of marine law enforcement, environmental education, boating safety, boating recreation and navigation improvement. If approved, funding will be made available in the individual major maintenance projects.

Award contracts for environmental maintenance services for an initial period of one year with the option to renew for three additional one-year periods to: A+ Environmental Restoration, LLC; Aquatic Weed Control, Inc.; Cardno, Inc.; Deangelo Brothers, LLC dba Aquagenix; EarthBalance Corporation; Environmental Restoration Consultants, Inc.; Mettauer Environmental, Inc.; Peninsula Improvement Corporation dba Collier Environmental Services; Sandhill Environmental Services, LLC; Walker Exotic Tree Eradication & Mitigation, LLC and Woods and Wetlands, Inc. Total expenditures for these products and services during Fiscal Year 2017-2018 were approximately $1,409,060.67.

Division of Natural Resources has been awarded a $120,000 grant from Florida Fish and Wildlife Conservation Commission (FWC) for the construction of an artificial reef using at least 1,000 tons of secondary concrete at Chris Koepfer’s artificial reef site. The artificial reef will create habitat for marine life and a new destination for residents, visitor anglers and scuba divers.   If approved, funds for the project will be available in the FY18/19 budget.

    Amendments to Rule 40E-8.221, Florida Administrative Code to Revise the
    Minimum Flows and Levels (MFL) Criteria for the Caloosahatchee River (Staff contact, Don Medellin, ext. 6340)
    Agenda Item Background:
    In 2010, the Governing Board provided direction and funding to implement 11 new research studies on the Caloosahatchee River to re-evaluate the existing
    Minimum Flows and Levels (MFL) rule. In 2016, the 11 studies were presented for review and technical input at a 2-day Public Science Symposium in Ft. Myers. Since then, additional scientific analyses and modeling were conducted to develop revised MFL criteria. In 2017, a 5-member panel of independent scientific experts reviewed the draft MFL Technical Document, visited the
    Caloosahatchee River and held a public peer review session. The District received a very positive peer review of the MFL technical document and the scientific approaches and methodologies used to revise the MFL criteria. In 2018, two rule development public workshops were held in Ft Myers. In response to public input, District scientists have completed additional scientific analyses and revised the duration criteria of the MFL rule. Based on this compilation of scientific studies, monitoring, modeling, technical evaluations, peer review and public input, staff proposes to amend Rule 40E-8.221, F.A.C., to increase the MFL flow criteria at the S-79 structure from 300 cubic feet per second (cfs) to 400 cfs and to revise the duration and return frequency components of the ML criteria. The Joint Administrative Procedures Committee has reviewed the proposed rule and does not have any comments.
    Recommended Action:
    Adopt amendments to Rule 40E-8.221, Florida Administrative Code to revise the Minimum Flows and Levels (MFL) criteria for the Caloosahatchee River.

    Lock Tender Contract Services for the Operation of Navigational Boat Locks –
    Clewiston, Okeechobee and St. Cloud Areas of Responsibility, Glades, Hendry,
    Martin, Okeechobee, Osceola and Polk Counties (Staff contact, Chris Edelstein, ext. 2952)
    Agenda Item Background:
    The District owns 11 navigational boat locks that allow for public boating access within Lake Okeechobee and along the Kissimmee River Waterway from Lake Tohopekaliga to Lake Okeechobee. Six of the locks are located on the perimeter of Lake Okeechobee and five are located within the Kissimmee River Waterway. This contract provides for annual lock tender services to operate the 11 locks.
    Recommended Action:
    Resolution No. 2018 – 0920 Authorize a 3-year contract with one 2-year renewal option with ECO Preservation Services, LLC, the lowest responsive and responsible bidder, for operational services of District navigational boat locks within Lake Okeechobee and along the Kissimmee River

      Approve the FY 19 Interlocal Agreements with the City of Tampa and the City of Temple Terrace to share boat registration fee revenue. The City of Tampa is to receive $182,000, and the City of Temple Terrace is to receive $60,000 from the County Boat Registration Fee program to support marine law enforcement activities. The allocation of $182,000 to the City of Tampa and $60,000 to the City of Temple Terrace is included in the FY 19 recommended budget in the Countywide Boat Registration Fund within the Governmental Agencies Department of Conservation and Environmental Lands Management.

      Approve an interlocal agreement with the City of St. Petersburg, City of Tampa, and Pinellas County to fund the Tampa-St. Petersburg Ferry Service. The service will be provided from November 1, 2018 through April 30, 2019. Equal amounts of $150,000 will be contributed by each of the four signors to the interlocal agreement, for a total of $600,000. On August 2, 2018, the City of St. Petersburg approved a License and Operating Agreement between the City of St. Petersburg and HMS Ferries, Inc. to manage and operate a seasonal passenger ferry service between St. Petersburg and Tampa for up to the next three years. Funding for the interlocal agreement is included in the FY 19 Recommended Budget.
